The Petition

My Six year old reminded me yesterday, that you don't need to go it on your own to prove yourself. She is 'thought' to have Dysphraxia, though we are not certain nor is any of the health professionals. She told me she was embarrassed around her friends that she could not speak properly, but then went on to explain that although she may be embarrassed she was happy receiving help.
Now I tend to get embarrassed, I have very low self confidence, in my writing skill especially. I tend to ramble and when I get face to face with someone I do not know I tend to get very shy.
Writing a petition was quite difficult, every time I wrote something down I felt like I was not making sense. To put it out to yourself made me cringe as I always feel something can sound better, but I need help - I need help to convince people that it is unfare and that we deserve better. My daughter is very smart - and I guess she somehow egged me on to ask you all for help even If I dislike my writting skills.

Cleary the Middle man isn't working

We put our faith the law, we rely on it for Justice. Rather than seeking that justice ourselves we rely on the law, the court's the lawyers, but this middle man is lazy. That is to say he may be lazy, but if we were to go out and seek revenge ourselves his ugly head would raise and we'd be the one in trouble.
We must accept what the middle man says, even if we think he has done a terrible job apparently. Should we? Just sit here and take that from the Justice system that is designed to get us Justice?
Should we accept this unfair trial! Well the Criminals don't need to accept it, if they feel they were locked up for no good reason they can appeal but US the Innocent families do not have that right - we are told to be quiet! I do not feel this man, this system is actually the middle man, he is more like the quarter line man sitting further beside the criminal that he is the innocent family.
I would really love to hear from you lot out there, I would love to know that I am not the only one who feel's we, the innocent families should be sitting here accepting that the middle man has became the quarter man - who works for the criminal and shy's away when the innocent questions why they did not get Justice.

I would love to find others out there - who would march to through Edinburgh or London to show that we deserve a better Justice System which does not only work in favor of the crook! .. I would love to hear opinion.

Restorative Justice



They say restorative justice works wonder's it help's those who have been effected by a crime ask the criminal why they done it, and basically they get the opportunity to show the criminal exactly how they have effected there life. The criminal also gets 'shocked' into seeing how their actions have caused more than just a death (Etc)

So what about us who never got Justice, Us who should have been given the opportunity to be proud of the justice system and were denied that right? We don't get to use this 'Restorative Justice' .. we don't get Justice and we do not get to show the Criminal what they done - Because the Court/Jury Acquitted them, the people who really have no clue as to how it effects the innocent got to Acquit the Criminal and to carry on with their business while us the Innocent got more than we ever expected, We got to Loss a family member, we may have got to watch other family members in pain, we got to arrange a funeral, we got to sit with our thoughts, and we got to watch a criminal smile while walking the path to freedom. (etc)

So seriously, we get to sit and wonder each day if the person thinks about what they done, what they caused. We get to know they are out their living their life while we are living a life we would not have been living if it were not for their careless actions. AND we do not even get access to Restorative Justice .. Which to me would be a rather grand happening - I would love to sit across from the man who killed my mother and ask him Why .... But I am not even sure I am allowed to contact him - and even if I were would he be able to say I was hassling him, get to call the police and possibly take me up on charges for asking him Why he done it - Well we never know these days - Possibly. I would love to do it in a legal setting but I guess us innocent families who get the rough side of the stick do not get any Pro's. We all but get to sit and wonder what we ever done to deserve this ...

So I put the question out to you - What Justice? Is there any? I have yet to see it ...

Why not just - move on?

I want to see a change in the Justice System, a Change in people's attitudes to the Victims familes who have lost someone due to a dangerous driver, yet people scratch their head as to why - 
I get this from time to time, people saying 'It's over', 'Your never going to get anywhere'. The best one has got to have been the Procurator Fiscal for the Arbroath/Forfar Area decided to tell me that I was being a bad mother by trying to fight them on this. How this works I have no idea and how she would know again I have no idea, this is almost part time as not only do you have to wait on letters and phone calls back - Finding someone that will actually talk to you is a hell of a task.
It's again that word the 'Accident' word that makes people wonder, that word is the plague of it all, it minimizes what the dangerous driver or careless driver has done. I want to erase the word 'Car Accident' from use if the driver has killed or seriously injured someone.
I came across a group yesterday 'The Forgiveness Project' they feel that we should forgive those who have wronged us IE One story they use is a woman who forgave her son's killer, and I do not know the background of the people running it so I will not say that they have no idea what it is like. What I will say is everyone has a different story, and everyone is different in the way they cope - so forgiveness is not for everyone. Another thing the forgiveness group mentions is it is good for your health to forgive and I'd agree to this, I had a whole lot of anger pent up inside and still do - But it is hard to forgive when you feel like it is a betrayal to the one you lost. Personally I have more anger towards the system who denied me and my family justice. The anger is mainly directed at the fact a not proven verdict can never have another chance at being proven, and that the double jeopardy bill which should have been brought in to help people who feel they did not get the justice they deserved due to lies, and false defense.
The forgiveness Project is doing a talk on 'No Forgiveness without Justice?' Which I would love to attend as this is rather true, I do not think I will ever forgive fully but if I got some justice it would go a long way to helping me let go. I feel that if the person who has wronged admitted guilt, and took the punishment then it would be easier to forgive but when they put in the plea of not guilty when they are blatantly guilty then it is a slap across the face for the family they have wronged.
Moving on will take me changing the system, and changing how people think. Making Society and MSP's/MP's look at what needs changed, and how attitudes make the innocent families of victims feel like there is no one to turn to, no one to listen. Every time I have sent a letter, I have got nothing but a list of why thing's were not done differently, but I want a list of what I can do to change it - As a letter telling me things cannot be different is not going to stop me pursing this.

Cars are Just as Dangerous as Knifes & Guns

We all get Shocked when we hear that someone has been killed by a Gun or Knife, people protest and the media covers it extensively. Petitions flow like running water, and politicians stand up and speak about it on what seems like a daily basis. What about those killed by a dangerous driver? Well for a start they normally say 'Accident' which drives me round the bend. It almost let's the dangerous driver off the hook. The word Accident seems to be the famous 'oop's word' - He was talking on his mobile phone, ignoring the road, and going against everything spoke about on the TV Adverts and Common Scene but it was an 'Accident' he killed three people in the car in front. We just seem to accept the word and society seems to let it go. If it is a knife or a gun - It is far from an accident but I think we are forgetting that a car is just as dangerous, and people have a responsibility the day they sign up for a provisional license to drive safely, the day they get their License they have an even bigger responsibility.
These boy racers, these drug drivers, drunk drivers - they all seem to get a slap on the wrist, told they are naughty and sent home with a telling off. Even though they have a responsibility, even though they were in control of a rather large weapon and did not use it safely.
The government need to start looking at car's in the way the look at a licensed gun, you are able to use it but should you kill someone with it you get punished. Car's are weapons which you can go and buy whether second hand or from any car dealer, they are perfectly legal, as long as you pass your test. You apply for a gun, but if you use it and kill someone society is shocked, you kill someone with your car and it was an 'accident' - The family of the Father killed by the gun, people feel such sympathy for, which is of course for a good reason, The family of the Father killed by the car, they pretty much get told to move on - 'It was an accident. What if it was not an accident what if some Idiot tried to Bunny Hop over the car, while in his car, from a verge, Or What if the Person was on their mobile, or what if they fell asleep at the wheel because they drove after a twelve hour shift, that is not an Accident that is just the way people are they do not want the inconvenience of having to get a bus or a train if they have their car. People who drink the night before and wake up and think - Ach I've slept the drink off enough, I am sure I am fine to drive now, Can't be bothered phoning a Taxi. If that person is in a Car Crash people say it was an 'Accident'.
We need to start thinking that these Car Crashes are more than just accident's, they are people who do not respect the life's of others, they are people who do not want to be inconvenienced with giving a second thought. These people are just as bad as the ones who take a gun to someone else as they have the responsibility for their own actions, they have the responsibility to question their ability - IE I cannot TXT and drive, I Cannot Drink and Drive, I Cannot drive as I am far to tiered. They are at the end of the day operating a vehicle that should be considered a weapon if it is not operated

Driving with a Problem

Those of you who have read this blog will know my Mother's Killer, his lawyers put through a Plea of 'Epilepsy', his wife said 'He blacked out' and he himself said he had blackout's. The thing is He had 'blacked out' before, and crashed his car, prior to killing my mother so surely if he had indeed had black out's before, he should not have kept driving.
Those who know that something is wrong, should stop driving and take a trip down to their doctors surgery, I don't care if you drive for your job, or you need the car for your kid's, or you live in the country and cant get back and forth without your car - Order a damn taxi.
If you drive with a known problem, you are not only putting yourself at risk you are putting the life's of the kid's in the back of your car at risk, you are putting the life's of others at risk. All because you can't just take yourself to a doctor's surgery which takes all of ten minutes.
In my opinion those with epilepsy should not have a driving license, as sad as it may be, why endanger their life and the lives of others at the expense of convenience. Robert Forbes, his doctor's lied and said epilepsy only to say he did not after the criminal trial, but Robert Forbes after having previous imaginary blackouts that he said he had, even in this false little story they came up with - He should have been jailed for driving in the 'knowledge' he had blackouts and had not visited a doctor.

So please - If you know you are not well, if you have blackout's or feel tired all the time or whatever, and it will effect your driving ability. Just don't - visit a doctor.

~A bit about Kathy~


A bit about my Mum, the person who should still be here today, the person who the Justice System did not feel was important enough to actually hand justice down to her killer.
She was always there for my brother and I, our dad left when I was five not that I put any blame on to him as He is with a woman who makes him happy, and has a daughter, my sister who I can not imagine being without. It did make things hard though, as we had no where to live, we went from place to place. My nana's at first but things did not work out so we moved to my aunte's but there was very little space for us, her husband and three boy's so we moved to my friend's house but again hardly any space and eventually we got a place in the Inverclyde center which is a rather large building with many little flats for people 'inbetween' getting a house. We got a flat in one of the most roughest area's in the end up and even though I was eight at the time I could tell my mum was scared, but she tried to hide it. Throughout the few years she was at College/University she also worked, and took care of my brother and I. While having to move from house to house, as landlords were selling the houses out from under our feet, and the council were placing us in area's even the rats did not want to wonder. She got through University and became a RMN, she looked so great on her graduation day!
Eventually as I went into 3rd Year at high school she found the perfect man for her, he took my brother and I on as though we were his own and I wouldn't be without him now. She made a grand choice and was finally smiling. They traveled Scotland with my brother and I and without when we were at my dad's. They went and bought caravan's, and got married. We then moved through to Brechin after I left School and she finally 'Had all her duck's in a row' she had her Job, she had bought her house, she was happy. She was taken from us when she had finally got herself where she wanted to be.

I can always remember how she seemed to get her youth back when she met my step-dad, and how my brother and I drove her crazy :)

One time that sticks out in my head was when we went to our caravan in Dunoon, which had 'Sinking mud' at the back of the end Row of caravan's. My brother and cousin decided to take a walk in their wellies, when they got stuck and started to sink, having no idea how to get them out I ran back to the caravan where my mum had decided to take a nap,#Bang Bang# at the caravan door - Yelling to her that they were sinking, she did not believe me one little bit for a good few minutes then decided that I was being that serious, and started to run towards them in her PJ's and Slippers. The state we all got into with them both sinking, my mum sinking and me pulling them all as she started to sink to. I bet somewhere in Dunoon - those wellies are still stuck in the mud as when we eventually got them free the wellies were stuck firm tops of wellies just viewable.

She loved to party that's for sure, we had many good times throwing BBQ's or parties at her friends house, caravan park entertainment. Ceilidh's were one of her favorites though.

She deserved so much better, and that's why I will not rest until I make a difference. It would be great to get justice for her, but even if I do not get the dangerous driver who killed her locked up - I would settle for making sure no one else goes through this.

S.C.I.D AGM

I've been invited to the S.C.I.D AGM, which takes place next month, which I am rather excited about, as I have never been to one and have also never met Margaret Dekker who I have spoken with on and off since 2005.

S.C.I.D, (Scotland's Campaign against Irresponsible Drivers), were there for me when I needed a ear. Margaret especially. When you find yourself lost in a sea of grief, shock, and totally lost after loosing someone in a car crash, and ontop of everything you have no idea how the system works, S.C.I.D are there. Not only are they there prior to a court case they are there during and after.

This is seven years on and I still find the advice that is given extremely helpful. This AGM invitation has me feeling extremely smiley and I am really looking forward to hearing what they have got to say. Glasgow bound in June!

A free criminal

I do not think those who work in Politics or Law have the slightest clue what innocent families go through when, those families know they have been denied the Justice they so rightly deserve. There is so many things that can happen, including family members ending up with mental health issues. My main issue is the feeling of betrayal. Scotland I am proud of, but our legal system has much to answer for.
What do you do when you know someone dangerous is on the road, driving around, after four car crashes (Maybe more now) and in one of those crashes he has killed and injured. Yet he still holds a license!?

I read on the BBC news a few days ago that a man has been sentenced for driving without a license, he is banned for driving for life. Although I agree, I still wonder, he has not killed anyone and has been driving around for years without a license and he will never drive again, yet someone with a license can Kill - and still hold a license? How does this work?

The people with the power to do so need to look at why the law works in favor of the criminal and why families of victims do not receive Justice, Or help.

These Criminals - are Still Criminals, Whether the court has acquitted them or not - the people know. They are just a free Criminal.
